Nashville Brain Injury Lawyer

We’ve Won Millions for Injured Victims in Tennessee

Trauma, toxins, and other harmful events can have far-reaching effects on the brain, and can change the lives of victims in profound and permanent ways.

Whether a brain injury is caused by a preventable accident, a defective product, or medical malpractice, speaking with an experienced attorney about your rights and options can ensure you have the support to recover your losses and any future needs – even if you are not yet aware of what those may be.

Kinnard, Clayton & Beveridge has fought for seriously injured victims and families for over 40 years. Our Nashville brain injury attorneys know the unpredictable consequences of traumatic brain injuries, and are available to help your family seek justice for losses that could and should have been prevented.

Proven Experience in Brain Injury Litigation

KCB Partners Randall Kinnard and Daniel Clayton are Certified Civil Trial and Medical Malpractice Specialists, which means they have attained the expertise needed to litigate complex and high-stakes claims – particularly those involving catastrophic injuries and medical negligence.

Our team has successfully resolved many cases involving brain injuries – from clients who’ve suffered concussions in vehicle wrecks to victims who’ve been permanently disabled due to medically induced anoxic brain injuries.

Examples of brain injury cases we’ve handled:

  • $15.2 million for a 23-year-old man who became severely disabled following an anoxic brain injury caused by medical staff who inappropriately removed a trach tube. The recovery set a record for the largest verdict in Weakley County history.
  • $6.5 million verdict from a Davidson County jury for a woman who aspirated and suffered a brain injury after her nasogastric tube was removed too early by medical staff.
  • $2 million verdict for a 7-year-old girl who suffered a traumatic brain injury in a school bus accident.
  • $1 million jury verdict for a woman who suffered oxygen deprivation resulting in a brain injury after a family practitioner failed to diagnose pneumonia

Causes of Brain Injuries

Brain injuries come in many different forms, and be caused by many different factors. These include:

  • Trauma: Traumatic brain injuries (TBI) are acquired brain injuries resulting from an outside force, and are not hereditary or present at birth. TBIs typically result from blunt force trauma and head injuries such as those sustained in car accidents, falls, construction accidents, and other types of traumatic events.
  • Oxygen deprivation: Hypoxic and anoxic brain injuries refer to brain damage caused by a lack of oxygen. In the case of hypoxia, that means an insufficient supply of oxygen in brain tissue; in the case of anoxia, it means a complete lack of oxygen. Both forms of oxygen deprivation can cause permanent and profound disability, if not death. Common causes include drowning, electrocution, and strokes, and well as medical negligence, such as the failure to diagnose a serious condition, surgical errors, anesthesia errors, and birth injuries.
  • Non-impact injuries: TBIs can occur even without direct impact or injury to the head. Sudden forces which cause the brain to rapidly move or accelerate within the skull can be enough to damage tissue. These injuries may result from auto accidents involving whiplash, or from industrial accidents involving explosions.
  • Toxic exposure: Some brain injuries can be caused by exposure to toxic substances, whether that means exposure from the environment or the workplace, from an unsafe product, or from dangerous medications.

Whether the injury occurred as a result of a motor vehicle accident, an accident at the workplace or a defective product, the effects of a brain injury can be far-reaching – affecting a person’s mood, behavior, cognitive abilities, and overall physical, emotional, and financial health.
