Injured in a Crosswalk Accident?
Pedestrians are among the most vulnerable victims during car crashes. Unlike motorists and their passengers, pedestrians lack the protection a vehicle provides. If you were seriously injured by an oncoming vehicle while crossing the street, you deserve the chance to seek compensation for your injuries and any damages you may have incurred.
At Kinnard, Clayton & Beveridge, our pedestrian accident lawyers are committed to working with our clients to ensure that they are put in the best position possible to secure the legal outcome they need. Reach out to us today to learn more about your legal options and start to put together a plan of action that best suits your needs.
TCA 55-8-134 outlines the protections pedestrians should expect when using a crosswalk:
- Oncoming vehicles must yield the right-of-way to pedestrians on the same half of the road they are travelling on, or pedestrians who are close enough while approaching that half of the road to pose a potential danger.
- Oncoming vehicles must come to a complete stop when pedestrians are using a crosswalk in a marked school zone with warning flashers in operation regardless of the half of the road they are on.
- Vehicles approaching from the rear may not overtake and pass any vehicle stopped at a marked or unmarked crosswalk.
Filing a lawsuit can seem incredibly stressful, but our Nashville pedestrian accident attorneys at Kinnard, Clayton & Beveridge have spent decades working with injured victims, helping them fight to secure the compensation they need. We will help you throughout the entire process to ensure that you understand each step and are prepared to handle anything that may come up during your case.
We Have Recovered Millions in Verdicts for Our Clients
In 2013, 4,735 pedestrians were killed, accounting for 14% of all traffic deaths. An additional 66,000 were injured that year as well, mostly among people aged 65 or older. These deaths can occur for a number of reasons—driver error is a leading cause, often tied to alcohol, drug use, or distracted driving.
However, other factors can cause pedestrian injury as well. Poor road design, poor road conditions, or bad vehicle maintenance are plausible issues in many pedestrian collision cases. As a firm, we work with expert investigators and consultants to root out every possible cause of your injury.
